CNN —When it comes to deciding whether former President Donald Trump should be booted from Colorado’s ballot, the easiest path the Supreme Court could take now may wind up causing the most chaos early next year. In the ballot litigation, Trump is appealing a decision from the Colorado Supreme Court in December that he incited the attack on the US Capitol as electoral votes were being counted in 2021. Arguments at the US Supreme Court last week focused less on whether there was an insurrection and more on technical questions about whether states may enforce the ban. A political fight over eligibility would likely be limited to Congress, but it could sweep the Supreme Court back into the thicket, as well. “Depending on just how horrendously ugly the situation could get, the court might feel compelled to become involved,” Foley said.

Justice Ketanji Brown Jackson has had to weigh in on more legal questions related to the January 6, 2021, attack on the US Capitol than the other jurists on the bench. Jackson, while serving on a federal trial-level court in Washington, DC, oversaw a handful of criminal cases against rioters as the Justice Department was making its first batches of arrests after the deadly attack. “How close can a person be to unquestionably violent and completely unacceptable lynch-mob-like acts of others and still claim to be a nondangerous, truly innocent bystander,” Jackson said in the case of one rioter. CNN —Peter Navarro, a former trade adviser to President Donald Trump who was convicted of contempt of Congress, has been ordered to report to prison after a judge denied Navarro’s effort to stay out of prison while he appeals the conviction. Trump has pledged to appeal and has until Monday to ask the Supreme Court to temporarily block the ruling. Perhaps to speed things along, the appeals court established a quick schedule for Trump to respond to Tuesday’s ruling, giving Trump until February 12 to file an emergency stay request with the Supreme Court. Though not official until US District Judge Tanya Chutkan’s order Friday, it became increasingly less likely that the March trial date would hold. Washington CNN —Peter Navarro was sentenced Thursday to four months in jail for contempt of Congress after defying a subpoena related to the congressional investigation into the January 6, 2021, US Capitol attack. Each count carries a mandatory minimum sentence of one month in prison, but prosecutors had asked Mehta to sentence Navarro to six months for each count – running concurrently – and fine him $200,000. Former Trump adviser Steve Bannon was convicted in 2022 on two contempt counts and later sentenced to four months in prison. The Justice Department used its testimony to make the case that the committee had good reason to subpoena Navarro and that he was informed repeatedly of its demands. Washington CNN —Former President Donald Trump isn’t immune from being held accountable in civil lawsuits related to the January 6, 2021, US Capitol riot in a long-awaited, consequential decision from the federal appeals court in Washington, DC. The decision arises out of lawsuits brought by Capitol Police officers and Democrats in Congress. The district court did find that Trump was protected by presidential immunity from the claim that he failed to stop to the riot, saying that he would be acting in his official presidential powers in that instance. Trump still will be able to contest the facts of the case as the lawsuits move forward. The appeals court said Trump also may be able to make more arguments around immunity before the January 6 lawsuits move into extensive evidence-gathering phases.

Atlanta CNN —Former President Donald Trump’s attorneys in the Georgia election subversion case are set to defend their client in a Fulton County courtroom for the first time on Friday as they try to have the charges thrown out on First Amendment grounds. This is the first time Trump’s attorneys will appear in court in the Fulton County case, though their client won’t be with them. Trump hasn’t yet been in the Atlanta courthouse – he previously waived his right to an arraignment hearing – though he was processed at the Fulton County jail in late August. Referring to the alleged ill -will Smith and his family have for Trump, the former president said Smith is “about at 10” and his family is “about a 15 on a scale of 10.”Some of Trump’s attacks against Smith stem from the activities of his wife, filmmaker Katy Chevigny. CNN —A federal appeals court on Friday temporarily froze the limited gag order issued against Donald Trump in the former president’s election subversion criminal case in Washington, DC, allowing him to again speak freely with criticism of possible witnesses in the case. Now, the appeals court will consider whether it will grant relief to the former president in the matter. “The prosecution’s request for a Gag Order bristles with hostility to President Trump’s viewpoint and his relentless criticism of the government—including of the prosecution itself,” Trump’s attorneys told the appeals court in a filing Thursday. “The Gag Order embodies this unconstitutional hostility to President Trump’s viewpoint. It should be immediately stayed.”The order restricts Trump’s ability to publicly target court personnel, potential witnesses, or the special counsel and his staff.

CNN —Twitter turned over at least 32 direct messages from former President Donald Trump’s account – @realDonaldTrump – to special counsel Jack Smith earlier this year as part of the federal election subversion investigation, according to newly unsealed court filings. The unsealed filings shed new light on the extent of the special counsel investigation into Trump’s efforts to overturn his 2020 election loss. Much of that conduct played out publicly, including on Trump’s Twitter account, where he promoted bogus claims of mass fraud and urged government officials to disrupt certification of the results. At the time of the prosecutors’ court argument to the appeals court, Trump wasn’t charged in federal court in either case. Another court filing unsealed Friday said that the warrant sought information from October 2020 through January 2021.

The price of bitcoin surged Tuesday after the U.S. Court of Appeals for the DC Circuit ruled that the Securities and Exchange Commission was wrong to deny crypto investment giant Grayscale permission to convert its popular bitcoin trust into an ETF. "Today's decision reaffirms that a bitcoin ETF in the U.S. is a matter of when, not if," said Steve Kurz, Global Head of Asset Management at Galaxy, which filed with Invesco for its bitcoin ETF. Grayscale initiated its lawsuit against the SEC in June 2022 after the agency rejected its application to turn its bitcoin trust, better known by its ticker GBTC, into an ETF. The company decided to pursue the ETF, which would be backed by bitcoin rather than bitcoin derivatives, after the SEC approved ProShares' futures-based bitcoin ETF in October 2021. The Grayscale Bitcoin Trust itself jumped 16%.

At least three court cases touching legal issues that could affect special counsel Jack Smith’s approach are ripe for rulings from the DC Circuit. But the start of the new DC Circuit term in early September puts additional pressure on the circuit judges to clear out their opinions in lingering cases.
